Terms of Service

1. The service

Quantify AI is a software platform that connects mortgage borrowers with licensed Malaysian mortgage brokers and provides those brokers with operational tools for case management, commission tracking, and client communication.

We are not a bank, not a lender, and not a financial advisor. Loan decisions are made by licensed financial institutions; advice is provided by licensed brokers using our platform.

2. Eligibility

You must be 18 years or older, a Malaysian resident or permanent resident, and legally capable of entering financial contracts to apply for mortgage products through Quantify AI.

3. Accounts

• Agents must be invited by an admin of a registered Quantify AI agency. Login credentials are non-transferable. We may suspend any account engaged in fraud, client harassment, or material breach of these terms.
• Referrers register through the referrer registration form (/referrer/register) using a link shared by an existing agent. Registration requires NRIC, bank account details, and acceptance of four declarations (data accuracy, fee terms, PDPA, AML). Approval is at the agent’s discretion. Referrer fees are paid only on successfully closed mortgage applications, 30 days after lender disbursement.
• Borrower clients using the public calculator without identity verification do not have an account. A case is only opened when the agent verifies your NRIC and you sign the bank’s consent form.

4. Borrower obligations

If you submit a mortgage application through Quantify AI:

• The information you provide must be accurate and current. Falsified income, identity, or property documents are a criminal offence under Malaysian banking law.
• You authorise your servicing agent to forward your documents to the bank you select. Each bank submission requires a fresh signed consent form from you.
• You may withdraw your application at any time before the bank issues a Letter of Offer; once issued, withdrawal terms follow the bank’s policy.
• You may opt out of the Quantify AI CRM at any time. Documents required by regulatory retention (AML, tax) may be retained as described in the Privacy Policy.

5. Calculator results

Calculator outputs are estimates based on the information you provide and current market rates. They are not loan offers, not commitments by any lender, and may differ from actual approved terms after the bank’s underwriting. We do not guarantee any specific interest rate, approval outcome, or savings figure.

6. Acceptable use

You will not:

• Submit false, misleading, or stolen information
• Upload documents belonging to anyone other than the borrower (or with their written authorisation)
• Use the calculator to scrape data or harvest leads programmatically
• Send unsolicited WhatsApp messages via our infrastructure
• Reverse-engineer or attempt to access our systems beyond intended use
• Resell or redistribute platform access without our written consent

7. Subscriptions and billing

For agencies on paid plans (Starter / Pro / Enterprise):

• The Free tier requires no payment and has no minimum term
• Paid subscriptions auto-renew monthly until cancelled
• Cancellations take effect at the end of the current billing period; no refunds for partial months
• Each plan includes a fixed cap of WhatsApp utility and marketing messages per month (see pricing). Once the cap is reached, the agency may upgrade tier or wait until the next billing cycle. We do not currently bill per-message overages.
• Failed payments grant a 7-day grace period before service suspension. Data is retained per the Privacy Policy retention schedule during suspension.
• Sales-led agencies may be granted time-limited trial upgrades (e.g. “Pro for 30 days”). When the trial expires, the agency reverts to its prior plan automatically.

8. Disclaimers

The service is provided “as is” without warranties of any kind. We make no warranty that loan applications submitted through Quantify AI will be approved or that calculator estimates will match approved offers. Outages may occur for maintenance.

9. Limitation of liability

To the maximum extent permitted by Malaysian law, our total liability to you in any 12-month period is capped at the fees you paid us in that period. We are not liable for indirect, consequential, or lost-profit damages.

10. Termination

Either party may terminate the relationship with 30 days’ written notice. We may terminate immediately for material breach of these terms or fraudulent activity. Upon termination, your data is retained per the Privacy Policy retention schedule.

11. Governing law

These terms are governed by the laws of Malaysia. Disputes are resolved in the courts of Kuala Lumpur.
